If you are a current or former employee of Pierce County Library System (PCLS), a family member of a current or former employee or a current or former contractor who received notice from Pierce County Library System (PCLS) and your personal information may have been impacted in the Data Incident disclosed in July 2025, then you may be a Class Member and eligible for Settlement benefits. Excluded from the Settlement Class are: (i) PCLS and PCLS’s parents, subsidiaries, affiliates and any entity in which PCLS has a controlling interest; (ii) all individuals who make a timely election to be excluded from this proceeding using the correct protocol for requesting exclusion; (iii) the attorneys representing the Settling Parties in the Litigation; (iv) all judges assigned to hear any aspect of the Litigation, as well as their immediate family members; and (v) any person found by a court of competent jurisdiction to be guilty under criminal law of initiating, causing, aiding, or abetting the Data Incident, or who pleads nolo contendere to any such charge.
If you are a Class Member and wish to receive one or more of the following Settlement Benefits, you must file a Claim Form by September 28, 2026.
Settlement Class Members may submit claims for: (1) Compensation for Ordinary Losses, (2) Compensation for Extraordinary Losses, (3) Reimbursement for Attested Lost Time, (4) an Alternative Cash Payment, and/or (5) Credit Monitoring and Identity Restoration Services.
The following benefits are subject to a $385,000.00 aggregate cap: (1) Reimbursement for Monetary Losses, (2) Reimbursement for Attested Lost Time, and (3) an Alternative Cash Payment. If the total approved claims for these benefits exceed $385,000.00, the benefits will be reduced, pro rata, so that the volume of all payments does not exceed $385,000.00.
Credit Monitoring and Identity Restoration Services: All Settlement Class Members are eligible to claim three (3) years of Credit Monitoring and Identity Restoration Services provided by IDX/Zerofox. This service will provide protection and monitoring shall include, at a minimum:
credit monitoring with at least one major credit reporting agency
identity restoration services through IDX/Zerofox
$1,000,000 identity theft insurance with no deductible
Reimbursement for Attested Lost Time: Settlement Class Members are able to claim up to four (4) hours for time spent remedying issues related to the Data Incident, at the rate of $20.00 per hour, for a maximum payment of $80.00.
Compensation for Ordinary Losses: Settlement Class Members can claim up to a total of $250.00 per person for ordinary out-of-pocket losses incurred as a result of the Data Incident, including, without limitation bank fees, long distance phone charges, cell phone charges (only if charged by the minute), data charges (only if charged based on the amount of data used), postage, gasoline for local travel, fees for credit reports, credit monitoring, or other identity theft insurance product (incurred on or after April 15, 2025, and fairly traceable to the Data Incident).
Compensation for Extraordinary Losses: Settlement Class Members can claim up to a total of $4,000.00 per person for extraordinary out-of-pocket losses incurred as a result of the Data Incident. Claims for Extraordinary Losses must: (1) be an actual, documented, and unreimbursed monetary loss stemming from fraud or identity theft; (2) establish that the loss was more likely than not caused by the Data Incident; (3) establish that the loss was incurred after the date of the Data Incident; and (4) establish that the loss is not already covered by one or more of the other reimbursement categories.
Settlement Class Members submitting claims for Ordinary Losses and/or Extraordinary Losses must submit third-party documentation supporting their claims. This can include receipts or other documentation that document the costs incurred but does not include documentation that is “self-prepared” by the claimant. “Self-prepared” documents such as handwritten receipts are, by themselves, insufficient to receive reimbursement, but can be considered to add clarity or support to other submitted documentation.
Alternative Cash Payment: In lieu of submitting a claim for Attested Lost Time, Ordinary Losses and/or Extraordinary Losses, Settlement Class Members may submit a claim for a cash payment of $70.00.
